Is Violating the Intentions of a Rule Cheating?

In other words, if there is some loophole that allows you to violate the intention of the rules without violating the wording of the rules, is that cheating?

Or put another way, if someone follows the rules word for word (i.e. technically they were not violating the rules), but the rules were flawed (i.e. the people who wrote the rules forgot to cover a situation they did not anticipate), is that cheating?

Why or why not?

Also, would it matter if they knew they were violating the intentions of the rules?

Also, would it matter if they were asked to stop what they were doing, and they refused to do so since it was not against the wording of the rules, although clearly against the intention of the rules?

my mom works at a tax authority and she always told me "nice" stories about people who use the holes of the laws for their own prosperity. She can see it's bad but she, inthe name of the law, can't do nothing and he/she is clear and can continue. Some of our politicians have their own companies (or their family etc.) using these holes and they have no motivation to change and improve the rules.

I think it is cheating if they were informed they were violating the spirit of the rule.  Just like when people kept crashing the server because they found a loophole in voting in the battle, and ignored Scott's plees to stop crashing the server because "it was not against the rules."
 
Even if it is not cheating, it's pretty @#$% selfish.

For the record, CaribbeanChoice has never considered using a loophole to vote in the battle as "cheating."  However, we can see how other people would think so.

The purpose of this topic is discuss what people think about it, not to determine what CaribbeanChoice thinks.
